02Intellectual Property

Unless otherwise stated, all intellectual property rights associated with the Site and its contents: including but not limited to source code, databases, software functionality, website design, audio, video, text, photographs, and graphics, are owned by Blue Peacock Technologies LLP or licensed to us. These materials are protected by Indian and international copyright and trademark laws.

03Copyright

All content provided on the Site and within Bisnexus, including text, graphics, logos, icons, and software, is the property of Blue Peacock Technologies LLP or its content suppliers and is protected by applicable copyright laws. Reproduction, modification, distribution, transmission, or display of the content on this Site without prior written permission from us is strictly prohibited.

04User Representations & Obligations

By using the Site and our accounting Services, you represent and warrant that (a) you have the legal capacity to comply with these Terms and Authority to bind your organization; (b) you will not use the Site for any illegal or unauthorized purpose; (c) your use of the Site will not violate any applicable law or regulation, including Indian tax and accounting laws; and (d) you will provide accurate and complete financial and personal information when requested.

05Account Setup

To access Bisnexus and certain features of the Services, you are required to create an account. You are responsible for maintaining the strict confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account to protect your financial data.

06Fees and Payments

Fees for our accounting Software, Professional Services, and Support are based on the pricing available on our pricing page or provided through a custom quotation upon request. For direct inquiries, we will provide a statement of work or a formal quotation tailored to the customer’s business needs.

Fees do not include taxes, duties, or other applicable levies, such as GST. If any taxes are imposed by regulatory authorities, customers are responsible for paying these additional amounts. Unless you provide valid tax exemption documentation, we may collect applicable taxes. Customers agree to reimburse Blue Peacock Technologies LLP for any taxes or duties paid on their behalf.

Payments must be made in advance unless otherwise agreed upon in writing. All fees are due within thirty (30) days from the invoice date. Fees are non-refundable and non-cancellable once paid. If payment is not received by the due date, we may suspend access to the Services after providing a written notice of thirty (30) days and reserve the right to charge interest on overdue amounts.

Blue Peacock Technologies LLP reserves the right to modify service pricing or introduce new fees. Any price changes will take effect at the start of the next billing cycle and will not impact your current subscription period. Users will not be charged for services unless they have explicitly subscribed to a paid plan.

07Submissions

Any questions, comments, suggestions, ideas, feedback, or other information you provide regarding the Site, Products, and/or Services ("Submissions") are considered non-confidential and become the sole property of Blue Peacock Technologies LLP. We will own all intellectual property rights to these Submissions and may use, reproduce, modify, distribute, and share them for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

By submitting content, you grant us an irrevocable, perpetual, sublicensable, transferable, non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, modify, adapt, translate, create derivative works from, display, and exploit your Submissions in any form, medium, or technology now known or developed in the future. We may also sublicense these rights to our affiliates and service providers without additional compensation or notice to you.

08Feedback

By providing suggestions, ideas, or feedback ("Feedback") regarding our Site, Products, or Services, you grant Blue Peacock Technologies LLP an irrevocable, perpetual, sublicensable, transferable, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, and exploit that Feedback for any purpose without any credit or compensation to you.

The Site and Bisnexus may contain links to or integrations with third-party websites or services (e.g., GST portals, banking APIs) ("Third-Party Content") that are not owned or controlled by Blue Peacock Technologies LLP. We are not responsible for the accuracy, completeness, or reliability of any Third-Party Content. Your use of such websites or services is at your own risk and subject to the terms and conditions of those third parties.

10Personal Information and Privacy Policy

Your use of the Site and Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, use, and processing of your personal and financial information as described in our Privacy Policy and in compliance with the DPDP Act, 2023.

We strive to ensure the continuous availability of Bisnexus and our Services. However, we do not guarantee that the Services will always be available or uninterrupted. We may suspend or terminate access to the Services at any time without notice for maintenance, updates, or other technical reasons.
